Okay, first of all, the driver is supposed to make sure that all passengers have their seat belts on. With that being said, they were both just out having fun and the worst scenario just happened to happen to them. You should expect this from a kid that drives a car 60 MPH sideways around turns.

john chose not to wear a seatbelt...therefor HIS fault, even though its sad...but it was ALL johns choices that night, nick didn't force him to get in the car and not wear a seat belt
