Depends on where you are. Legally any two wheeled vehicle with an engine less than 50cc is considered a moped where I am.

One point to make, if it doesn't have pedals, and you don't pedal it to start the engine, it isn't a moped, it's a scooter. MOtor+PEDals=MOPED

Yes I have a moped somewhat like that and I am actually looking to buy a back piece for mine. Because mine did not come with that.
